Habitual courtroom participant Lindsay Lohan finally took a plea deal that will send her to 90 days of lockdown rehab instead of the jail time she'd probably have gotten for lying to the police.

There's just one problem: New York, where Lindsay is expected to spend her three months in rehab, has no such thing as lockdown facilities. Which means LiLo could be going to jail after all. (Not that it's likely, but humor us here.)

TMZ did some research and found there aren't any New York rehab facilities that match the description of what California prosecutors and Lohan's shady counsel, Mark Heller, agreed upon -- which was a place where Lohan could not come and go as she pleased.

But according to a NY state agency, lockdown facilities there simply don't exist.

Considering La Lohan's penchant for sneaking out of facilities (past incidents occurred at the Cirque Lodge in Utah and the Betty Ford Clinic, just to name two) and considering this is supposed to be in lieu of, you know, jail, it's highly unlikely prosecutors will allow her to stay somewhere she can just breeze in and out of as she wishes.

With no guard on duty, that goes directly against the terms of LiLo's plea bargain -- which the court struck with Heller on his word that lockdown rehab places actually exist in NY.

Which apparently they don't. (No wonder the judge in this case once said Heller is incompetent.)

"The sentence was actually 90 days in custody, and lockdown rehab would satisfy that," a source said. "If there's no such thing, then she'll go to jail for 90 days."

DUUUUN DUUUN DUUUN!
