Jim Toth, hubby to Reese Witherspoon and alleged drunk driver, feels really bad about that whole DUI thing. So bad, in fact, that he may head over to rehab.

For those somehow unaware, Toth, 42, blew a hearty .139 on a Breathalyzer after he was pulled over by police for weaving and wobbling on the road. The legal limit in Georgia, where he was subsequently arrested and briefly incarcerated during the wee hours of Friday morning (April 19), is .08.

Witherspoon, 37, then played the Tracy Flick card with cops, sassing them and asking if they knew who she was -- and she wound up behind bars as well. (She's since offered a mea culpa.)

A source close to Toth told PEOPLE that the CAA agent "feels awful that he involved Reese in the situation. He made a bad decision and it certainly made things worse that he dragged her into it."

The source added that Toth "has to pay the consequences, bottom line. He gets that."

Those consequences may include a few steps -- possibly 12.

"Jim has always been a big social drinker," adds the first source. "A lot of his job is being social. He's out to lunch or dinner almost every day of the week, schmoozing clients and taking business meetings."

"[The arrest is] just going to make the two of them stop and pause, and think about maybe how much Jim's drinking plays a role in their lives -- if it does or not," the source said.

Another insider stated the obvious: "It's embarrassing for him. He'll have to explain himself to his bosses."

Yet another Toth source said, "No one would be surprised if Jim goes to rehab."

Hopefully he'll hire someone else to drive him there.
