Former husband and wife of 72 days, Kim Kardashian and Kris Humphries, were scheduled to rekindle their hatred for one another in person with a court appearance today, but there was one little problem: She was there, but he never showed.

The hearing was scheduled for 8:30 a.m. PST today (April 12) but Humphries was spotted in New York City at 1:00 a.m. looking "extremely upset" about not being on a plane, at least according to sources for TMZ. Even if he'd caught the earliest flight out of JFK this morning, he'd still have arrived two hours late to the hearing.

A hearing, by the way, in which he's seeking $7 million in "oh for God's sake just go away already" money from Kim.

A source told E! News that Kris is "claiming there was purportedly a delay or cancellation of sorts with his scheduled flight to Los Angeles, hence the no-show." (Do he and Lindsay Lohan have the same travel agent?)

Humphries' attorneys were present, but he'd have needed special permission to call in rather than appear in person (something he apparently didn't have). After assessing the situation, Judge Hank Goldberg explained that "the nature of settlement and settlement conferences under the evidence code are confidential" -- and then he punted the media from the courtroom.

To refresh your memory: Most of this legal wrangling is because Kim wants a divorce but Kris wants an annulment (purportedly because it would nullify the terms of his prenup and allow him to speak freely about his time as Mr. Kim Kardashian). To get it, he's claiming there was fraud, as in, "She only married me for TV ratings."

She, on the other hand, says she was totally in love when they swapped vows but it wore off a couple months later and damn, it's not like love lasts forever, you guys, geez.

Anyway, our understanding is that since this settlement hearing didn't go as planned, things will now move to trial (as planned) on May 6.
